YouTuber Jjuyang Appeals Partial Ruling on Video Deletion Lawsuit Against Ga Seo Yeon

YouTuber Jjuyang (real name Park Jeong-won) has reached a new phase in the lawsuit he filed against the YouTube channel Ga Seo Yeon and its representative Kim Se-yeol for posting videos related to his private life without permission.

Jjuyang's team has filed an appeal against the court's partial ruling.

According to legal circles on the 11th, Jjuyang's side submitted an appeal to the 51st Civil Division of the Seoul Central District Court (presiding judge Park Sang-eon) on the 7th.

This court previously issued a partial acceptance decision on Jjuyang's request for a temporary injunction to delete and prohibit the posting of materials against Ga Seo Yeon and Mr. Kim on the 17th of last month.

The background of this lawsuit involves controversies regarding Jjuyang's past experiences. Last July, Kim Se-yeol, the representative of Ga Seo Yeon, rebuffed claims that Jjuyang had been assaulted by his ex-boyfriend A for four years and had worked in entertainment establishments, countering that these claims were false and resulting in defamation charges. Furthermore, Ga Seo Yeon publicly released recorded conversations that indicated that YouTuber Gyujaeok and others had demanded money from Jjuyang regarding his past without his consent.

Court's Judgment and Jjuyang's Response

The court stated, “The content not only undermines Jjuyang's social value and evaluation but also is identified as infringing matters that should be protected as private matters,” deeming Ga Seo Yeon's actions inappropriate. Additionally, it pointed out that “posting videos on a YouTube channel accessible to the general public is an act that unlawfully infringes upon Jjuyang's honor and private matters, exceeding the scope of rightful exercise of rights.”

Consequently, the court ordered the deletion of some videos among those requested by Jjuyang's team that contained elements infringing on personality rights or private life. However, it dismissed Jjuyang's request for indirect coercion on the grounds that “an indirect coercion application can be made separately if circumstances arise.”

Jjuyang's team appears to have deemed the court's decision insufficient, leading to the appeal. This appeal is expected to prolong the legal conflict between Jjuyang and Ga Seo Yeon.
