Busan's First Application of 'Alcohol Evasion Prevention Law' Case Occurs

A man in his 50s was caught by the police in Busan after intentionally drinking alcohol to evade a breathalyzer test following a traffic accident. This is the first case of its kind since the implementation of the so-called 'Alcohol Evasion Prevention Law' that was amended last month.

On the 4th, the Busan Northern Police Station announced that they had sent A (male, in his 50s) to be unarrested on charges of violating the Road Traffic Act (obstruction of a breathalyzer test).

A is accused of colliding with a vehicle ahead of him on the morning of the 11th of last month around 9 AM and then fleeing the scene to purchase and intentionally drink two bottles of soju at a nearby convenience store.

In particular, it has been reported that A clearly expressed his intention to "drink and go" even after receiving a call from the police immediately following the accident.

He only voluntarily appeared at the police station at around 11:35 AM, more than two hours after the accident, and at that time, his blood alcohol concentration significantly exceeded the level for license revocation.

According to the police investigation, A was already suspected of being under the influence of alcohol prior to the accident, but by consuming more alcohol after the incident, he made it impossible to accurately assess his intoxication level at the time of the accident.

The Northern Police have applied charges of obstruction of a breathalyzer test to A under the amended Road Traffic Act, which came into effect on the 4th of last month.

The so-called 'Alcohol Evasion Prevention Law' was established to severely punish acts of intentionally drinking alcohol to obstruct breathalyzer tests after a traffic accident.

According to this law, drivers who hinder police alcohol testing using the 'evasion method' after a traffic accident can face imprisonment of one to five years or fines ranging from 5 million to 20 million won.

This case represents the first application of such charges in Busan since the amendment of the law, serving as a crucial reminder regarding the enforcement of drunk driving regulations.
