A woman, while sorting through her late husband's belongings after his sudden passing, discovered the shocking truth of his double life and significant financial support to a mistress.

In her fifth year of marriage, Ms. A recalled that her marital life had been very harmonious. Although they had no children, her husband would prepare gifts for every anniversary and they traveled abroad together twice a year.

Due to his job requiring frequent travel, her husband would send photos of his daily life from his work trips to reassure his wife, and Ms. A stated that she had never suspected him.

However, a tragedy struck a few months ago when her husband suddenly died while on a business trip. Deeply shocked, Ms. A found something shocking while sorting through his belongings on his laptop. It was filled with affectionate photos of her husband with another woman, and the messaging app KakaoTalk still held conversations with a woman who appeared to be his lover.

Shocking Double Life Revealed by Bank Statements

Ms. A found the woman's phone number in her husband's mobile phone and tried to call her, but the woman hung up immediately upon hearing Ms. A's voice.

Later, when Ms. A checked her husband's bank statements, she was hit with an even bigger shock. It was revealed that her husband had purchased a house for that woman and had sent her money multiple times starting two years ago.

Ms. A expressed her despair, saying, "My husband was leading a double life," and that the thought of her husband's warmth being nothing but a lie was incredibly painful.

When Ms. A contacted the woman again, the woman claimed that she believed Ms. A's husband was divorced and asserted that she was the victim. She further claimed that the money received from him was merely for living expenses, but Ms. A could not bring herself to believe it.

Ms. A explained, "I found out that the woman seems to have recently opened a café in an apartment complex in a new town, and it appears that my husband lent her business funds."

A friend of Ms. A suggested filing a lawsuit against the mistress to recover the money given by her husband and to post on a mom community forum to disrupt the café's business.

Regarding this case, attorney Shin Go-won from Shinsegye Law Firm advised, "Even if you discover the infidelity after your husband's death, if you suffered mental anguish due to the adultery that occurred during the marriage, you can file a compensation claim against the mistress."

He explained that even if the mistress claims she did not know he was married, if there is evidence in messages or conversations indicating she was aware of the wife’s existence, she could be held accountable.

Attorney Shin also stated, "If the mistress argues that the money sent by the husband was a 'loan,' then clear evidence such as a loan agreement or interest payment would be necessary." He added that even if the mistress claims it was a 'gift,' the court would consider the amount, relationship, and intent of repayment altogether. In particular, he noted that repeated small transfers over a long period are more likely to be recognized as gifts.
