Former Public Official Sentenced to Probation for Assaulting and Breaking into a Woman's Home
A former public official who chased and assaulted a woman returning home late at night has been sentenced to probation by the court.
On the 11th, the 11th Criminal Division of the Seoul Northern District Court (Judge Lee Dong-sik) announced that it had sentenced a man in his 40s, referred to as A, to 1 year and 6 months in prison, with a probation period of 3 years, for violating the Sexual Violence Punishment Act (home invasion rape).
A is accused of breaking into a woman's apartment on the night of September 3rd last year in an attempt to rape her.

At the time of the crime, A was employed as a public official at a district office in Seoul. According to the investigation, it was found that the victim was forcefully dragged into her home while being placed in a "headlock" by A.
The court determined that it was difficult to recognize the intent to commit rape based solely on A's actions or the victim's testimony. However, it concluded that home invasion and assault charges were acknowledged as reduced facts of the indictment.
It is difficult to recognize the intent to commit rape.
The court stated, "Considering the circumstances and methods of the crime, the culpability is not light," and "We took into account that A deeply reflects on his actions." Accordingly, while A avoided a prison sentence, he received a probation sentence requiring him to comply with the law for the next three years.
