Kim Byeong-man, Re-explains Reason for Rejection of Adoption…”It Doesn’t Serve Our Mutual Interests”

Comedian Kim Byung-man (50) has once again explained the reasons for the termination of the adoption of his child. Previously, Kim Byung-man's side stated that the wrongful act of Person B was the reason for the termination; however, it has been confirmed that the court excluded this aspect from its judgment.

On the 11th, Kim Byung-man's agency, Skyturtle, apologized, saying, "We are sorry for causing concern due to unfavorable articles. We feel regretful and apologize."

On the 8th, Kim Byung-man received a ruling from the Seoul Family Court regarding the termination of the adoption of Person B. As a result, Person B has been legally excluded from Kim Byung-man’s family.

At that time, Kim Byung-man's side stated, "It has been recognized that there were acts of misconduct toward the adoptive parents," explaining the reason for the termination. They asserted that Person B's testimony, claiming to have witnessed the assault of his mother (Kim Byung-man's ex-wife), is considered a false claim.

Kim Byung-man's side has clarified the facts. They stated, "The adoption was terminated based on the welfare of the now 25-year-old child (Person B) and aspects that do not align with each other’s interests."

According to Article 908-5 of the Civil Code, there are two grounds for the termination of an adoption:

1. When the adoptive parents have abused or neglected the adopted child or have otherwise severely harmed the child's welfare (Article 1);

2. When the adopted child's misconduct makes it impossible to maintain a relationship with the adoptive parents (Article 2).

In other words, Kim Byung-man’s side interprets that the termination was acknowledged under Article 2. This is understandable, as Person B has previously expressed a desire not to be terminated in three separate adoption termination lawsuits.

Ex-wife S has also accused Kim Byung-man of habitual injury and sexual assault. Person B appeared as a witness in this case and as a result, Kim Byung-man has filed a criminal complaint against him for false allegations.

The court in charge of the lawsuits involving Kim Byung-man and Person B stated, "Person B has not seen Kim Byung-man for about six years since 2019," and concluded that "the intimacy was also lost due to the divorce lawsuit and criminal case between Kim Byung-man and ex-wife S."

Furthermore, it pointed out that "Person B has been in a position where, if he took one side during the divorce and criminal investigation process, he would inevitably face criticism from the other side for years."

It was also highlighted that Kim Byung-man and S have used their adoptive relationship as a negotiating tool. The court added that considering Person B is now a 25-year-old adult woman, "the necessity of leading an independent life is pressing."

The court comprehensively considered the mentioned reasons and deemed it to fall under "other severe harm to the welfare of the adopted child" (Article 1). It stated, "We do not further judge whether it falls under Article 2."

Kim Byung-man did not have a wedding ceremony with S and began their marital life by reporting their marriage, during which he adopted a child who was 9 years old at the time.

Afterward, they separated in 2012, and a dispute regarding Kim Byung-man's income, including his appearance fees, arose in July 2019, leading to the initiation of divorce proceedings.

During the divorce proceedings in 2020, the first adoption termination lawsuit was filed, followed by a second termination lawsuit in 2022.

Through the third termination lawsuit in November 2024, Kim Byung-man received a ruling on August 8, 2025, from the Seoul Family Court, which determined the termination was in the welfare's interest of the now 25-year-old child and based on aspects that do not align with each other’s interests.

Kim Byung-man hopes that this ruling will prevent further harm to the child he adopted through his marriage registration with S.
