Holding a broken bowl and saying "I will jump off"… Emotional abuse recognized

A daughter in her 50s, who economically depended on her elderly mother in her 90s and even resorted to self-harm to demand money, has been sentenced to a fine for emotional abuse.

On the 17th, the Chuncheon District Court's Wonju branch chief judge Park Hyun-jin sentenced A (55), who was indicted for violating the Elderly Welfare Act, to a fine of 1 million won.

On the morning of October 11, 2020, A visited her mother's home, demanded "Money, please," and attempted self-harm with a broken bowl, threatening, "I will die, and I will make sure everyone dies. If you don't give me money, I will jump off."

This was not all. On the morning of June 19 last year, while caregivers and social workers were conducting a handover in her mother's bedroom, A reportedly threatened her mother again, saying, "If you don't give me the money I asked for, I won't let this go. When I leave this house, it won't be pretty."

During the trial, A acknowledged her self-harm but denied making statements like "I will make everyone die" or "I will jump off." She claimed these were words spoken in the heat of the moment and asserted she did not intentionally threaten or abuse her mother.

"I never said I would make everyone die"… but the court's judgement was different

However, the court did not accept her claims. A had admitted to self-harming, and the testimonies of the caregivers and social workers present at the scene were deemed credible. The court dismissed A's and her lawyer's assertions, stating, "Such actions constitute emotional abuse."

The court further stated, "Considering the nature of the offense, the lack of remorse, and the economic dependence on the victim, the sentence was determined." A's side has indicated their intention to appeal.
