Family's Video Distribution… "Led to Family Destruction"

A man in his 50s, who was tried for distributing videos of his wife's infidelity to family members, has been sentenced to a suspended prison term.

According to the legal community on the 4th, the Busan District Court sentenced Mr. A, who was indicted for violating the Act on Special Cases Concerning the Punishment of Sexual Violence Crimes, to 2 years in prison, suspended for 3 years, and ordered him to complete 40 hours of sexual violence treatment programs.

A woman in her 40s, Ms. B, who was indicted alongside him, received a fine of 1 million won.

Mr. A is accused of infiltrating his apartment through a balcony window on June 2, 2022, to capture footage of his wife, Ms. C, with another man, and filming the infidelity scene with his mobile phone. He later sent the video to his wife’s family and his own children three times.

Additionally, Mr. A faces charges of threatening his wife in August of the following year by saying, “I will post this video in the apartment's group chat.”

Ms. B, identified as an accomplice, was also tried for allegedly assisting Mr. A in order to secure evidence of infidelity in her divorce proceedings with her husband.

The court stated regarding Mr. A, "Although there was a purpose to secure evidence of infidelity, the private video of the victim (the ex-wife) being distributed among family members resulted in the destruction of the family. Even if the video did not spread to an unspecified number of people, it seems that the victim has suffered serious psychological damage as it was exposed to the family."

Ms. B claimed, "There is no fact that I conspired with Mr. A," but the court did not accept this argument.

The court explained the reason for Ms. B's fine, stating, "Defendant B denies her charges and shows no remorse, and she has not received forgiveness from the victim."
