Husband Damages Mistress’s Car Twice… What Did the Court Decide?

A husband who intentionally damaged the vehicle of the man his wife was having an affair with has been sentenced to pay a fine.

According to the legal community on the 20th, Judge Park Dong-wook of the Chuncheon District Court's Criminal Division 3 sentenced 48-year-old A to a fine of 5 million won for property damage.

According to the prosecution, A is accused of intentionally damaging the vehicle of B (52) in a parking lot in Inje-gun, Gangwon Province at approximately 10:17 PM on August 20 of last year.

A used an unidentified tool to break the front, rear, and side windows of B's vehicle, resulting in repair costs estimated at about 4 million won. An investigation revealed that B had been having an affair with A's wife.

Continuous affair maintained

Evidence for increased punishment due to repeat offenses, but some mitigating factors considered

This incident was not A's first offense. According to court records, A had previously received a summary order for damaging the same B's car windows in March of the same year.

The fact that A repeatedly committed similar offenses against the same victim in a short period of time was considered in sentencing.

The court stated in its ruling, "The defendant has acknowledged the crime and appears to show remorse, and there is somewhat of a mitigating factor regarding the circumstances that led to the crime against the person who was having an affair with his spouse."

However, the court also pointed out that "the victim has not been compensated or reached a settlement, and the defendant committed the crime again," explaining the reasons for imposing a fine.
