Female Accuses Male Colleague of Sexual Assault to Cover Up Infidelity
A woman in her 30s was sentenced to one year in prison for falsely accusing her male colleague of sexual assault to hide her affair from her husband.
On the 12th, Judge Jang Chan-soo of the Gwangju District Court’s Criminal Division 3 announced that a real prison term of one year was imposed on A, who was indicted on charges of false accusation.
A was charged with falsely reporting her colleague to the police in Gwangju for sexual assault in February of last year.
In January of the same year, A had an affair with B after finishing a work dinner and engaged in sexual contact at B's home.
When her husband noticed unusual signs of physical contact on A's body and confronted her, A lied, claiming she was a victim of a sexual crime by B.
To conceal the affair, A even submitted a complaint claiming that “B forcibly groped her while she was intoxicated after a work dinner.”
However, the investigation found that A was not in an impaired state at the time and had actively engaged in physical contact, leading to the conclusion that she reported false facts to portray B as a sexual assailant.
Evidence from Home Camera Reveals Colleague's Innocence of Sexual Assault
The court determined, based on evidence, that A had falsely accused her colleague B of sexual assault.
Evidence such as home camera footage from B's house and phone calls and messages exchanged between A and her husband at the time she claimed to be a victim supported the charges of A's false accusation.
The court stated, "If there had been no taxi receipts from the dinner and no home camera footage from the victim's house on the day of the incident, it is highly likely that the victim would have been framed as a sexual criminal."
Furthermore, the court remarked, "The defendant expressed affection and, when caught by her husband after returning home, committed the act of false accusation, indicating a serious quality of the crime and a high level of blameworthiness."
