Views of Former Acting Chief Justice Moon Hyung-bae on the Statements of Former President Yoon Suk-yeol During the Constitutional Court Impeachment Trial

Former Acting Chief Justice of the Constitutional Court Moon Hyung-bae has raised strong questions regarding the statements made by former President Yoon Suk-yeol during the impeachment trial.

In an interview with the Kyunghyang Shinmun reported on the 27th, Moon expressed, "I thought it was a lie when he said he never instructed anyone to 'pull out the National Assembly members.'"

Political Neutrality of Constitutional Court Justices and Commitment to Uphold the Constitution

Moon candidly shared that watching former President Yoon personally appear and argue in the Constitutional Court eight times made him think, "The truth cannot be hidden forever."

He also revealed statements made by Yoon to reporters on his way to work the day after the martial law was announced. At that time, Yoon said, "I believe that the constitution should operate particularly in times of political confusion," explaining that the 'constitution' mentioned includes "inevitably the impeachment."

In response to a question about whether the political tendencies of Constitutional Court justices influence their judgments, Moon replied, "Decisions are made according to the constitution, the law, and professional conscience."

He emphasized the professionalism and neutrality of the justices, stating, "Of course, there is also the unconscious, but at least I believe that they start from the conscious realm."

Regarding the composition of the Constitutional Court, Moon explained, "There is never a case where one political faction fills six seats, whether conservative or progressive," suggesting that this indicates a direction to find the right path through dialogue and persuasion.

When asked about the special pardons by the President, including the Independence Day pardon of former Justice Minister Cho Kuk, Moon remarked, "It is advisable for the President to exercise special pardons cautiously. I will only say that."
