Ziyang Wins Legal Victory Against Garoseoro Research Institute… Fine of 10 Million Won for Each Video Posting
YouTuber Ziyang (real name Park Jung-won) has achieved a significant legal victory in the provisional injunction lawsuit he filed against the Garoseoro Research Institute and Kim Se-eui for 'deletion and prohibition of video posts'.
The Seoul High Court partially granted Ziyang's appeal, deciding to impose an indirect coercive fine of 10 million won for each violation if the Garoseoro side posts related videos.

According to reports from Edaily, the 25-2 Civil Division of the Seoul High Court (Chief Judge Hwang Byeong-ha, Jeong Jong-gwan, Lee Kyun-yong) stated on the 24th that "it is necessary to order the payment of an indirect coercive fine of 10 million won for each violation if Garoseoro Research Institute and Kim Se-eui post live broadcasts, videos, or postings about Ziyang," thereby partially granting the appeal.

The appellate court particularly pointed out that "the debtors posted videos with the purpose of expanding or reproducing related rumors or allegations even after the first instance decision was made."

It also ruled that "Without a separate indirect coercive decision, it appears highly likely that the debtors will repeatedly produce and post videos or postings that violate the first instance decision in the future."
This ruling differs from the first instance where Ziyang's side partially won, but the request for indirect coercion was dismissed.
In the first instance, the court only ordered the deletion of certain videos containing elements that infringe personal rights or privacy, and dismissed the request for indirect coercion on the grounds that "it can seek indirect coercion through a separate application when circumstances arise." As a result, Ziyang's side immediately appealed last month, and part of the appeal has now been granted.

The origins of this case date back to last July. At that time, Kim Se-eui and the Garoseoro Research Institute released recordings, claiming that Ziyang was threatened after they used his past work in entertainment establishments against him.
As related broadcasts continued, Ziyang's side filed a complaint against Kim and Garoseoro for violations of the Stalking Punishment Act, as well as threats and coercion, and applied for a provisional injunction for video deletion.
With this ruling, the Garoseoro Research Institute and Kim Se-eui face significant financial burdens if they post videos related to Ziyang, establishing an important legal precedent for the protection of the personal rights of YouTube content creators.
