Suspicion of Refusing Breathalyzer Test, South Chungcheong Provincial Councilor Denies Allegations
A South Chungcheong provincial councilor appeared in court on charges of refusing a breathalyzer test, claiming, "I have never been asked to take a breathalyzer test," and completely denied the allegations.
On the 25th, Choi Kwang-hee, a South Chungcheong provincial councilor, strongly refuted the charges of violating the Road Traffic Act (refusal to take a breathalyzer test) during a hearing at the Daejeon District Court's Criminal Division 3 (Judge Yang Si-ho).
During the trial, Councilor Choi testified in response to his attorney's questions, stating, "The police officer used a sobriety tester instead of a breathalyzer." He emphasized, "There was only a request for a sobriety test, and there was no request for an official breathalyzer test," asserting that he had no intention to refuse such a test.

Councilor Choi also pointed out procedural errors on the part of the police. He claimed that he was arrested without being informed of the reasons for his arrest, his right to legal counsel, and his right to remain silent, known as the "Miranda Rights."
When asked by his attorney if he had been properly informed of the Miranda Rights, he responded, "I was not informed." However, Councilor Choi did admit to the fact that he had been drinking and driving.
He was charged for refusing to comply with a police officer's request for a breathalyzer test after a citizen reported suspected drunk driving on March 20 of last year at around 8:30 PM on a road in Boryeong.
After concluding the examination of the defendant, the court is expected to proceed with sentencing, including the prosecution's recommendation, the defense's final arguments, and Councilor Choi's final statement.
