Math Tutor Sentenced to Probation for Repeated Sexual Assault Against Teen Student

A math tutor in Gwangmyeong, Gyeonggi Province, has been convicted by the court for repeatedly committing sexual crimes against a minor student in an apartment study room.

According to the legal community on the 22nd, the Ansan Branch of the Suwon District Court's Second Criminal Division (Presiding Judge Park Ji-young) sentenced the defendant, referred to as A, to 3 years in prison with a 5-year probation for charges of sexual assault under the Youth Protection Law.

The court also ordered A to undergo 200 hours of community service, attend 40 hours of sexual violence treatment lectures, and be prohibited from employment in child, adolescent, or disabled-related institutions for 5 years.

Total of 11 Instances of Sexual Assault… Continued Sending 'Harassing Texts'

A is accused of committing sexual assault 11 times against a teenage girl, referred to as B, while tutoring her in math in a study room in an apartment in Gwangmyeong from March to June of last year.

In particular, in May of last year, A suddenly hugged the victim, saying, "I missed you, please hug me," and continued to engage in inappropriate behavior during a conversation about perfume the next day, stating, "I like people who smell good."

A repeatedly held the victim's face with both hands or hugged her, and inappropriately pressed on various parts of B’s body while asking if she had menstrual cramps. These actions represent a serious breach of trust between an educator and a minor student.

Exploitation of Teacher-Student Relationship for Sexual Crimes… Court’s Ruling

The court pointed out, "A repeatedly assaulted a teenager he was tutoring during tutoring sessions, and considering the relationship with the victim, the location and situation of the crimes, and the nature of the assaults, the severity of the offense is concerning." It noted, "The victim likely experienced significant sexual humiliation and mental distress, and A has not received forgiveness from the victim."

Furthermore, the court added, "Although A has made a criminal deposit for a certain amount for the victim, considering the will of the victim and their legal representative, it is difficult to regard this as a mitigating factor for a favorable sentencing."

However, the court explained, "The degree of the assaults and the extent of physical force used were not severe, and after comprehensively considering various factors in the arguments regarding A's age, behavior, circumstances, family relationship, motives and reasons for the offenses, means and outcomes of the offenses, and the circumstances following the crimes, we determine the sentence accordingly," leading to the sentencing of probation.
