A woman suddenly jumped out onto a bicycle path… A 12-year-old male student becomes the offender.
An accident occurred on the Han River Park bicycle path where a 12-year-old male student collided with a female pedestrian who suddenly entered the path, resulting in serious injuries to both individuals.
This incident, which was revealed through the YouTube channel 'Han Moon-cheol TV' on the 11th, took place at 6:40 PM on the 20th of last month at the Yeouido Han River Park bicycle path.

The video captures the moment when the male student, referred to as A, collides with the female pedestrian who unexpectedly stepped onto the bicycle path.
As a result of the impact, A sustained bruises to his arm and ankle and complained of dizziness from a concussion, while the female pedestrian suffered more severe injuries, receiving an 8-week medical diagnosis for wrist and elbow fractures. Both individuals were transported to the hospital by ambulance.
Liability and Legal Proceedings of the Accident
The day after the accident, on the 21st, the pedestrian's daughter reported the incident to the police, formally registering the case.
A tipster presumed to be A’s parent expressed concern, stating, "I heard that if the case is not settled with a non-prosecution request, it will be sent to the family court," and asked, "What happens if it is sent there? In this case, does the cyclist automatically become the offender?"

In response, lawyer Han Moon-cheol conducted a poll on air with three options: 'Cyclist is more at fault', 'Pedestrian is more at fault', and 'Pedestrian is 100% at fault'.
Out of 50 participants in the poll, 30% (15 people) voted for 'Pedestrian is more at fault', while 70% (35 people) voted for 'Pedestrian is 100% at fault', and no one voted for 'Cyclist is more at fault'.
Another lawyer also stated, "I don’t think the cyclist is at fault."
He continued, "If we take the standard when the pedestrian stepped onto the roadway, it seems that the cyclist would have had no way to avoid the accident, but if we take the standard before the pedestrian entered the roadway, there might be some fault on the part of the cyclist," thus withholding a clear judgment.
Regarding concerns about being sent to family court, he advised, "Do not worry at all. Even if it is sent to the juvenile department, it will likely just conclude with something like 'parents, please provide proper education.'"
