A, a nurse in her eighth year of marriage, stated, "My husband pressured me, asking, 'Are you really not going to have kids?'" She continued, "When I replied that my thoughts hadn't changed, he initially tried to persuade me but gradually became indifferent towards me."

She added, "I believed I could live happily with my husband forever, even without children, and really tried my best. But my husband drifted further away, neglecting household chores and prioritizing drinking with friends."

As a result, their relationship naturally deteriorated, and they began to sleep in separate rooms three years ago.

Signs of infidelity and shocking discoveries

In response, A suggested they attend couples counseling, but her husband ignored the idea.

Then one day, her husband's behavior began to change. He was seen laughing while looking at his phone alone at the dining table and started paying more attention to his appearance.

Seeing her husband's altered behavior, A became convinced he was in contact with another woman.

Ultimately, while her husband was asleep, A checked his phone and discovered shocking information. The photo album was filled with pictures of her husband happily posing with an unknown woman.

She also found high-end brand handbag purchase records, receipts, and captured text messages indicating that "the woman is pregnant."

A expressed her anger, saying, "The woman probably didn't know my husband had a wife. The thought that he cheated because of a child made my blood boil." She added, "Seeing the affectionate messages he sent to the mistress makes me feel numb. If I ask for a divorce, my husband will surely blame me. What should I do in such a situation? Can I claim damages from both of them?"

In response, attorney Shin from the law firm Shinsegye stated, "It is difficult to claim legal grounds for divorce solely because A maintained her stance of not having children, given that they agreed on this at the time of marriage. However, if the husband has cheated and impregnated another woman, A can file for divorce on the grounds of infidelity."

He continued, "Even if the husband claims, 'We slept in separate rooms, so it isn’t infidelity,' such justification cannot be upheld. A has even tried to recover their marital relationship by suggesting counseling. It would be difficult to accept the husband’s argument."

However, regarding the husband's intention to sue A for breaching privacy due to her secretly unlocking his password-protected phone, attorney Shin remarked, "This act constitutes a violation of privacy under criminal law. Regardless of past password sharing, it could lead to prosecution."
