Court rules in favor of Tzuyang… “Gaseyeon, delete ‘privacy exposure’ video”

Jiyang Receives Partial Injunction Decision to Delete Video Against Gaseyeon and Mr. Kim

YouTuber "Jiyang" (real name Park Jeong-won) is currently involved in a legal dispute regarding the publication of videos related to personal privacy against Mr. Kim, the head of the YouTube channel Gaseyeon. The court sided with Jiyang.

On the 17th, Chief Judge Park Sang-eon of the Seoul Central District Court's Civil Affairs Division 51 issued a partial injunction decision in the case of Jiyang's application for the deletion and prohibition of video posts against Mr. Kim.

The court stated, "This video is sufficiently damaging to the social value and evaluation of the creditor (Jiyang) and constitutes an invasion of matters that should be protected as private matters." The court further noted, "The act of posting videos on a YouTube channel accessible to an indefinite number of people goes beyond the legitimate exercise of rights and is considered an unlawful infringement on the creditor's honor and private matters. It is not viewed as pertaining to matters of public interest."

Intensified Legal Battle, Jiyang Raises Questions About Investigation Fairness

Previously, in July of last year, Mr. Kim publicly disclosed related recordings, claiming that "Jiyang was threatened by YouTuber Gyujaek (real name Lee Jun-hee)."

Mr. Kim asserted that "Jiyang was threatened over her past work in an entertainment establishment." In response, Jiyang clarified that "she worked in the entertainment establishment due to violence and coercion from her ex-boyfriend," but Mr. Kim continued his YouTube activities suggesting that Jiyang's claims were "not factual."

As a result, Jiyang filed a complaint against Mr. Kim for violating the stalking punishment law and for threats and coercion.

In February of this year, the police decided not to proceed with Mr. Kim's case due to insufficient evidence; however, the prosecution accepted Jiyang's objection and requested supplementary investigations from the police last month.

Meanwhile, Jiyang appeared at the police station as a complainant the previous day but refused to undergo questioning after about 40 minutes. Jiyang's attorney, Kim Tae-yeon, stated, "It seemed the police did not consider Jiyang as a victim at all and appeared to have no intention of protecting the victim," adding, "We had no information about the prosecution's supplementary investigation directives, which raises doubts about the fairness of the investigation."

"I hope that the investigation is conducted fairly so that no more victims emerge," Jiyang expressed her stance.
